Terms of Use

General Information

These Terms of Use (“Terms”) are an agreement between ShowSubmit, LLC (“ShowSubmit”, “Us”, “We”, “Our”) and You (“You”, “User”, “Artist”). This page explains the Terms by which You may use the ShowSubmit.com web site (“Site”) and all ShowSubmit services (collectively, the “Services”).

By using the Services you are agreeing with these Terms. If you do not agree with any part of the Terms, do not use the Services.

Definitions

Users may be Organizations ("Owners", "Show Chairs") hosting calls for entry for an Exhibition ("Show", "Exhibition"). Artists are Users who create Entries (“Entry”), and upload Works (“Content”, “Works”, "Images") to be submitted into a Show. Works are Juried and Accepted or Rejected by "Jurors." Works can be Awarded by "Judges."

Artist Artwork Usage Consent

You agree that ShowSubmit has the right to reproduce any uploaded Works on the Site for advertising and promotional purposes only. We will ALWAYS attribute any Works we display to You clearly by name. You may “opt-out” by updating your preferences in your Account settings or by contacting [email protected].

Email Notifications

By creating an account on our Site, You are agreeing to receive e-mail communications related to your account and/or the Services. These emails are considered Transactional and are necessary (e.g., Entry Confirmations, Payment Receipt, Password Resets, Welcome Emails). Additionally, as an Artist submitting an Entry into an Exhibition, you are agreeing to receive email communications strictly related to the Show sent by Us on behalf of the Organization hosting the Show (e.g., Acceptance Notifications, Rejection Notifications, Awards Notifications, Exhibition Information updates).

Email Marketing

You also agree to receive other email communications, whether for marketing (“Call for Entry Announcements”, “Deadline reminders”, “Promotions”, etc.) or other business purposes. You may 'opt-out' of these at any time using your Account settings or by clicking “Unsubscribe” at the bottom of such email communications or by contacting [email protected].

You will never be spammed by ShowSubmit or an Organization using ShowSubmit. You may unsubscribe at any time.

Your Account

Your Account belongs to You. One Account, one email address, per person. Your account gives you access to the service and features that we create, maintain and modify, at our sole discretion. The Site has different types of accounts for different Users (Owners, Show Chairs, Artists, Jurors, Judges) that provide access to different Services or features of the Service. You are responsible for your own Account and agree to store all passwords securely.

Artist Uploaded Content

Works uploaded to the Site are entirely your responsibility. By uploading Works, You confirm you own the copyright to the Works. That the Works are original and Yours to upload. You agree that all Works adhere and conform to the Organization Show rules outlined in the Prospectus. Entries with Works that violate Prospectus rules or the Additional Content Prohibitions will be removed without refund. Second time violators will be banned from using the Site indefinitely. Please read all Prospectuses carefully.

Additional Content Prohibitions

You agree not to Upload Works that:

• is pornographic, fraudulent, immoral, infringing, illegal, harassing, offensive, or defamatory material;
• contains any information or content that we deem to be unlawful, harmful, abusive, racially or ethnically offensive, defamatory, infringing, invasive of personal privacy or publicity rights, harassing, humiliating to other people (publicly or otherwise), libelous, threatening, profane, or otherwise objectionable;
• contains any information or content that you do not have a right to make available under any law;
• promotes racism, bigotry, hatred or physical harm of any kind against any group or individual.

Usage Rights

By using this Site or Services You agree that you will not ever attempt to copy, reproduce, reverse engineer, alter, clone, harm, decommission, harm, or modify the Service.

Acceptances/Rejections

Juried exhibitions are competitive and it takes courage to enter Your Works to be judged. We know you will receive both Acceptances and Rejections. No matter how disappointing it is to receive a Rejection, You agree not to question Us or the Organization regarding the decision. Evidence of “Poor sportsmanship” or unruly Artists will not be tolerated and will result in an immediate and indefinite ban from using the Site. We have never needed to exercise this right, and hope we never have to! Just be kind.

Support

We work very hard to make sure the Site is a pleasure to use and is bug free. However, there may still be occasional issues and bugs, that is just the nature of web development. You may contact [email protected] during business hours and We are happy to help. We reserve the right to refuse support.

Notifications

Notifications of Acceptance, Rejection, Awards, etc. are emailed to the email address in your Account. If you do not receive a notification by close of business on the notification date, please login and view your Entry History. Accepted works will be noted. Support requests regarding the status of notifications prior to close of business on the notification date cannot be answered.

Security

We care about the security of your personal information. However, we cannot guarantee that unauthorized third parties will never be able to defeat our security measures and gain access to your personal information. You acknowledge that you provide your personal information at your own risk.

Storage

We store Works and data in multiple places for backup and recovery purposes. We also make every effort to keep an archive of all data. However, we reserve the right to remove or mark accounts as ‘inactive’ that are inactive for a period of time at our sole discretion.

Links to Other Websites

The Site may link to third-party websites or services that are not owned or controlled by ShowSubmit. ShowSubmit has no control over and assumes no responsibility for the content or policies of any third-party websites or services.

Applicable Law

These Terms are the relationship between You and ShowSubmit, all related matters will be governed by, and construed in accordance with the laws of the State of Colorado and the federal laws of the United States, without regard to conflict of laws principles.

Modification

We reserve the right, in our sole discretion, to modify or replace any of these Terms of Use, Privacy Policy, and Refund Policy at any time by posting a notice on ShowSubmit or by sending you notice via email. While we will timely provide notice of modifications, it is also your responsibility to check these Terms of Use periodically for changes.
