General Information

These Terms of Use (“Terms”) are an agreement between ShowSubmit, LLC (“ShowSubmit”, “we”, “us”, “our”) and you (“you”, “User”, “Artist”). This page explains the Terms by which you may use the ShowSubmit.com website (“Site”) and all ShowSubmit services (collectively, the “Services”).

By using the Services, you agree to these Terms, as well as our Privacy Policy and Refund Policy, which are incorporated by reference. If you do not agree with any part of the Terms, do not use the Services.

Definitions

Users may be organizations (“Owners”, “Show Chairs”) hosting calls for entry for an exhibition (“Show”, “Exhibition”). Artists are Users who create entries (“Entry”) and upload artwork (“Works”, “Content”, “Images”) to be submitted into a Show. Works may be juried and accepted or rejected by Jurors and may be awarded by Judges.

Your Account

Your account belongs to you. One account per person, per email address. Your account provides access to Services and features that ShowSubmit may create, maintain, modify, or discontinue at its sole discretion.

The Site includes different account roles (Artists, Organizations, Jurors, Judges), each with access to different features. You are responsible for maintaining the confidentiality of your login credentials and for all activity occurring under your account.

Eligibility and Age Requirements

The Services are intended for use by individuals who are able to form legally binding agreements.

You must be at least 13 years old to create an account on ShowSubmit. If you are under the age of 18, you may use the Services only with the involvement and consent of a parent or legal guardian, who agrees to be bound by these Terms on your behalf.

By using the Services, you represent and warrant that you meet these eligibility requirements and that you have the legal authority to enter into these Terms for yourself or on behalf of a minor for whom you are a parent or legal guardian.

Account Termination

You may request to close your account at any time by contacting [email protected]. Account closure does not entitle you to refunds and does not affect obligations incurred prior to termination.

ShowSubmit may suspend or terminate accounts at any time, with or without notice, for violations of these Terms, suspected fraud or abuse, security concerns, legal requirements, or for operational or business reasons.

Upon termination, access to the Services may be revoked and data associated with the account may be removed or archived in accordance with our data retention practices.

Artist Uploaded Content

Works uploaded to the Site are entirely your responsibility. By uploading Works, you represent and warrant that you own or control all rights to the Works, that the Works are original, and that you have the legal right to submit them.

You agree that all Works comply with the rules and eligibility requirements outlined in the Show’s Prospectus, including requirements related to originality, authorship, and use of artificial intelligence.

Entries with Works that violate Prospectus rules or these Terms may be removed without refund. Repeat or severe violations may result in permanent suspension or termination of your account.

Artificial Intelligence (AI) Use

Artists are responsible for ensuring that all submitted Works comply with the originality, authorship, eligibility, and any artificial intelligence (AI)–related requirements outlined in the Show's Prospectus.

ShowSubmit does not determine artistic authorship or originality. Any tools or indicators provided by ShowSubmit related to originality or AI use are informational only. Final eligibility, acceptance, and award decisions rest solely with the hosting organization.

Submission of Works that violate a Show's Prospectus, or discovery of prohibited AI use at any time, may result in disqualification, removal of the Work, revocation of acceptance or awards, and/or account suspension or termination, without refund.

Content Prohibitions

You agree not to upload, submit, or otherwise make available any Works or content that:

• is pornographic, sexually explicit, obscene, fraudulent, or illegal;
• is infringing, defamatory, libelous, or violates intellectual property, privacy, or publicity rights;
• contains abusive, harassing, threatening, hateful, profane, or otherwise objectionable material;
• promotes or depicts racism, bigotry, discrimination, hatred, or physical harm;
• you do not have the legal right to submit;
• violates any applicable law or regulation;
• violates the rules or restrictions of a Show’s Prospectus.

ShowSubmit reserves the right, in its sole discretion, to remove any content that violates these prohibitions. Removal may occur without notice and without refund.

Copyright Infringement and DMCA Notice

ShowSubmit respects the intellectual property rights of others and expects users to do the same.

If you believe that content on the Site infringes your copyright, you may submit a written notification in accordance with the Digital Millennium Copyright Act (DMCA) to:

A valid DMCA notice must include:

• identification of the copyrighted work claimed to be infringed;
• identification of the infringing material and its location on the Site;
• your contact information;
• a statement that you have a good-faith belief that use of the material is not authorized;
• a statement, under penalty of perjury, that the information provided is accurate;
• your physical or electronic signature.

ShowSubmit may remove or disable access to allegedly infringing content and may terminate accounts of repeat infringers.

Originality Validation Tools

ShowSubmit may provide tools or indicators to assist hosting organizations in evaluating originality, including duplicate detection, similarity analysis, reverse image search, or indicators related to disclosed or suspected AI use.

These tools are provided for informational purposes only and do not constitute a determination, certification, or guarantee of artistic authorship, originality, or eligibility. Final eligibility, acceptance, and award decisions rest solely with the hosting organization, in accordance with the Show's Prospectus.

License to Use Uploaded Content

By uploading Works, you grant ShowSubmit a non-exclusive, worldwide, royalty-free license to host, store, reproduce, resize, display, distribute, and otherwise use your Works solely for the purpose of operating and improving the Services, including jurying, judging, and online exhibitions.

Promotional Use

You grant ShowSubmit permission to reproduce Works for advertising and promotional purposes. ShowSubmit will make commercially reasonable efforts to clearly attribute Works to the Artist.

You may opt out of promotional use via account settings or by contacting [email protected]. This opt-out does not affect use required to operate the Services.

Online Galleries

ShowSubmit may publish online galleries displaying accepted Works and exhibition information.

Online galleries are generally intended to remain publicly accessible for an extended or indefinite period. However, ShowSubmit does not guarantee perpetual availability.

ShowSubmit reserves the right to modify, archive, restrict, or remove galleries or Works at its sole discretion for legal, technical, operational, financial, reputational, or policy-related reasons.

Email Communications

By creating an account, you consent to receive transactional emails necessary to operate the Services.

Artists entering a Show consent to receive Show-related emails sent by ShowSubmit on behalf of the hosting organization.

Optional marketing emails may be sent by ShowSubmit. You may opt out at any time using account settings or the unsubscribe link.

Payments and Fees

ShowSubmit facilitates payments for exhibitions hosted by independent organizations. ShowSubmit is not responsible for refunds or other financial arrangements arising from an organization’s decision to cancel, modify, or discontinue an exhibition. Refunds, if any, are governed by the Refund Policy.

Acceptances and Rejections

Juried exhibitions are competitive. Submission does not guarantee acceptance, rejection, or awards.

You agree not to harass, threaten, or engage in abusive or disruptive conduct toward ShowSubmit, hosting organizations, jurors, or judges. Evidence of poor sportsmanship may result in immediate and permanent account termination.

Support

Support is provided during regular business hours. While we make reasonable efforts to assist users, we do not guarantee immediate resolution and reserve the right to refuse support for abusive, unreasonable, or inappropriate requests.

Notifications

Notifications of acceptance, rejection, awards, or other show-related updates are sent to the email address associated with your account.

If you do not receive a notification by close of business on the stated notification date, you are responsible for logging in and reviewing your Entry History. Support requests regarding notification status prior to the close of business on the notification date cannot be answered.

Usage Restrictions

You agree not to copy, reproduce, scrape, reverse engineer, clone, harm, decommission, interfere with, or otherwise misuse any part of the Services.

Security

While we take reasonable measures to protect your information, no system is completely secure. You acknowledge that unauthorized third parties may gain access despite safeguards, and you provide information at your own risk.

Storage and Inactive Accounts

We store Works and data in multiple locations for backup and recovery purposes. We reserve the right to remove, archive, or mark accounts as inactive after a period of inactivity at our sole discretion.

Links to Other Websites

The Site may contain links to third-party websites or services not owned or controlled by ShowSubmit. We assume no responsibility for their content or policies.

Disclaimer of Warranties

The Services are provided “as is” and “as available.” ShowSubmit disclaims all warranties, express or implied.

Limitation of Liability

To the maximum extent permitted by law, ShowSubmit shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, revenue, profits, or reputation, arising out of or related to the Services.

In no event shall ShowSubmit’s total liability for any claim arising out of or related to the Services exceed:

• for Organizations, the total fees paid to ShowSubmit by the Organization in the twelve (12) months preceding the claim; or
• for all other Users, one hundred dollars ($100 USD).

Indemnification

You agree to indemnify and hold harmless ShowSubmit from claims arising from your content, your conduct, or your violation of these Terms.

Governing Law and Venue

These Terms are governed by and construed in accordance with the laws of the State of Colorado and applicable United States federal law, without regard to conflict of law principles.

Any legal action or proceeding arising out of or relating to these Terms or the Services shall be brought exclusively in the state or federal courts located in the State of Colorado, and the parties consent to personal jurisdiction and venue in such courts.

Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.

Waiver

The failure of ShowSubmit to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

Entire Agreement

These Terms, together with the Privacy Policy and Refund Policy, constitute the entire agreement between you and ShowSubmit regarding the Services and supersede all prior or contemporaneous agreements, communications, and understandings, whether written or oral, relating to the Services.

Modification

We reserve the right to modify these Terms at any time by posting updates on the Site or notifying you by email. Continued use of the Services constitutes acceptance.
